Terms & Conditions

General

  • MARINE CABS service all water access locations or destinations within the area of operation, subject to the Navigational and Safety requirements of the vessel or those requirements deemed by any competent or governing authority. This also includes the ability of the master of the vessel to readily access the destination without putting the vessel, passengers or crew in danger, access to shallow water areas will be at the master's discretion.
  • MARINE CABS will provide service from any Private Jetty, Pontoon or Facility. However the owner's permission is required for service to a private jetty or pontoon. It is deemed as the customers responsible for seeking and gaining this permission, where permission is not granted or gained, the customer agrees to accept responsibility for unauthorized use of the Private Jetty, Pontoon or Facility.
  • MARINE CABS reserves the right to provide a sub-contracted vessel or alternative means of transport where the need arises.
  • MARINE CABS reserves the right to alter fare and charter rates for all designated public holidays or special event days including but not limited to Christmas Eve, Christmas Day, Boxing Day, New Year's Eve, New Year's Day, Australia Day, and Valentine's Day, fares will normally be increased by a minimum of 50% on designated public holidays or special event days.

Payment, Fees and Confirmation

  • MARINE CABS will only confirm a pre paid water taxi transfer when MARINE CABS has received payment according to those arrangements made between MARINE CABS and the client to facilitate that payment, including the acceptance of these Terms and Conditions. Clients making online or phone bookings acknowledge having read and understood these Terms and Conditions before proceeding with any transaction.
  • Where passing trade customers board the MARINE CAB vessel without a booking, a fare will be discussed, accepted and paid in full prior to departure.
  • Except where a prepaid booking or invoicing / account arrangements are made, payment must be made on board the MARINE CABS Vessel.
  • Payments may be made using Visa, MasterCard, EFTPOS or Cash.
  • The Merchant Administration Fee for Credit Card & EFTPOS payments is 5% of the quoted fare, or a minimum fee of $2.50 per transaction, whichever is the greater amount.
  • Should you wish to prepay your travel, you MUST contact the MARINE CABS office and arrangements will be made to facilitate payment for your water taxi travel. If payment arrangements are not in place or facilitated prior to travel, payment must be paid in full on board.
  • Travel is charged for the number of people for which the trip is booked, or the number of people who travel, whichever is the greater number.

Waiting Charges

  • Please ensure that you or your group is ready to depart at the booked time(s). MARINE CABS may apply a waiting charge, at the masters discretion, if the taxi(s) are kept waiting more than 10 minutes from the booked time. Waiting charges are applied at the rate of $2.50 per minute / per taxi from the booked time, and are charged in 5 minute blocks.
  • Waiting charges incurred on prepaid bookings must be paid on board the Vessel.
  • MARINE CABS reserves the right to apply water taxi waiting charges and to charge these amounts to the credit charge or Eftpos card provided without notice.
  • Marine Cabs, at times, have extremely busy schedules and may not be able to wait or reschedule your travel if you are delayed. In the case that you are delayed and your water taxi leaves without you your credit Eftpos or charge card may be charged for any waiting time incurred by our operator and you will be deemed to have forfeited your trip.
  • In all cases your MARINE CABS Water Taxi operator will make all possible and reasonable efforts to contact you prior to forfeiture, or departure without booked passengers.

Cancellations

  • MARINE CABS reserves the right to charge the following cancellation fees where the water taxi cancellation occurs during following timeframes:
  • 100% of the quoted water taxi fee where cancellation occurs with less than 24 hours notice prior to the confirmed water taxi travel booking
  • 50% of the quoted water taxi fee where cancellation occurs within the timeframe 24 to 48 hours prior to the confirmed water taxi travel booking
  • 10% of the quoted water taxi fee or $20 whichever is the greater amount, where cancellation occurs with more than 48 Hours prior notice to the confirmed water taxi travel booking. A waiver of this cancellation fee will only be made in the case whereby the cancellation has no detrimental effect on MARINE CABS day to day business activities and where a rescheduling or rebooking of the trip is made, under the same conditions of carriage including but not limited to Tariff period, Number of Passengers, Pick-up and Drop-off Locations.
  • All Designated Public Holidays or Special Event Days other than Christmas Eve, Christmas Day, New Years Eve, New Years Day carry a 72 hour 100% cancellation policy.
  • Bookings for New Years Eve, New Year's Day and Christmas Day are payable at the time of booking and are non-refundable for any reason or under any circumstances, unless cancellation is due to those conditions outlined under the heading Weather Warnings and Safety and where those conditions are applied or imposed by the operator or authorized representative of MARINE CABS.
  • All pre paid bookings that are cancelled will incur a minimum 5% processing fee, over and above any other cancellation fee.
  • All Water taxi cancellations or booking alterations / changes must be faxed or emailed.
  • Water taxi cancellation is not effective until acknowledged by MARINE CABS.
  • Alterations or changes are not effective until acknowledged by MARINE CABS.
  • Where a change or alteration to a booking clashes with any other booking, the changed will be either rescheduled at Marine Cabs discretion or deemed to be treated as a cancellation by the customer.

Weather Warning and Safety

  • If a weather warning is issued for the area of transit by the Bureau of Meteorology, or any other competent body, MARINE CABS reserves the right to cancel all water taxi bookings if MARINE CABS deems conditions to be unsafe. Where MARINE CABS cancels the booking there will be no cost to the client and no redress against MARINE CABS by the client for the cancelled transfer.
  • MARINE CABS also reserves the right to cancel or amend any water taxi transfer that may have been booked, on the basis of sea safety or poor visibility conditions or to render lifesaving assistance to any stricken vessel at any time

Passenger Safety

  • MARINE CABS reserves the right to not embark or disembark passengers at any wharf, beach, pontoon or onto any vessel if the master deems such landing or berthing to present any danger to the vessel or the safety of his passengers such decisions are solely at the master's discretion at the time, if such a situation occurs MARINE CABS will convey those passengers on board to the nearest possible safe point of disembarkation.
  • MARINE CABS reserves the right to refuse embarkation of any person that may appear intoxicated or drug affected. MARINE CABS accepts no liability for refusing carriage of any such person whether they were indeed intoxicated or drug affected or not, such determination is solely at the master's discretion.
  • MARINE CABS requests that any passenger who deems themselves or would be deemed by any other person not be a proficient or competent swimmer, notify the master of the vessel and request that a lifejacket be issued for the duration of the on water transfer, Coastal lifejackets PFD Type 1, are available on board your vessel for the full passenger contingent, at all times. If you are travelling with any passenger who may need to be issued with a lifejacket, but for any reason is unable to notify the master themselves, please make the master of the vessel aware, and request that that person be issued with a suitable lifejacket.
  • In the event that the master of the vessel orders that passengers don their lifejackets, for reasons of personal safety, or due to sea conditions or imminent danger, this order MUST be complied with, MARINE CABS will not be held responsible by any passenger for any event arising from failure to comply with a direct order from the master of the vessel.
  • All instructions, orders or requests issued by the master of the vessel MUST be followed and complied with in full by all passengers and at all times. MARINE CABS accepts no responsibility for injuries or events arising through a passengers failure to comply with such instructions, orders or requests.

Changes to Terms and Conditions

MARINE CABS reserves the right to change these terms and conditions with out notice. Terms and Conditions are displayed on board each vessel and on our website; copies are available from our office. These terms and conditions may not be copied or distributed for any reason without written approval from MARINE CABS.
